These General Conditions of Use, Conditions of Sale and Privacy Policy (hereinafter 'CU'), regulate the use of the website www.shopbabunkers.com (hereinafter 'the Website') of which Calzados D'SIMONS S.L. (hereinafter 'Babunkers') is the owner. D'SIMONS is a Spanish limited liability company with registered office at Calle Gaviota, number 12, 45510 Fuensalida (Toledo), registered with CIF B-45022654.

Through its website www.shopbabunkers.comBabunkers provides information about its products and services and offers the option to purchase them. Due to the content and purpose of the Website, individuals wishing to purchase any of its products (hereinafter "customers") must complete all fields on the form before placing their order and indicate their acceptance and agreement to the Terms and Conditions in the version published at the time of accessing the Website.

Remember to use a valid email address (check that the email address is correct) and save your password in a safe place to access your customer panel.

In any case, there are pages of the Website accessible to individuals and legal entities who do not make any purchases (hereinafter "users"). Accordingly, users who access these parts of the Website agree to be bound by the terms and conditions set forth in these General Conditions, to the extent applicable to them.

Babunkers would like to inform its customers and users that it is exclusively aimed at an audience over 18 years of age.

Product information

The descriptions of the products displayed on the Website are as accurate as possible to the finished product. However, the information provided about each product, as well as any photographs or videos related to them, are provided for guidance only.

Prices

All product prices listed on the website include VAT. However, these prices do not include shipping costs or the costs incurred when choosing the cash-on-delivery payment method, which are detailed separately. The cost of shipping the products, as well as the costs of choosing the cash-on-delivery payment method, are detailed once the order is finalized and before you accept and pay for it.

discounts

Welcome discounts only apply to your first purchase. Exchanges will not apply if you request an exchange for another item.

Availability

Babunkers informs customers that under no circumstances will it intentionally sell more units than are in stock and that it will do everything possible to satisfy all its customers' demand for its products. However, occasionally, due to causes beyond Babunkers' control, such as human error or computer system issues, the quantity finally sold may differ from the actual quantity in stock.

In the event that the product is unavailable after the order has been placed, the customer will be informed by email of the full or partial cancellation. Partial cancellation of an order due to lack of availability does not entitle the customer to cancel the entire order. If, as a result of this cancellation, the customer wishes to return the delivered product, they must follow the instructions in the returns section.

Payment

The customer agrees to pay at the time of placing the order. The initial price listed on the website for each product offered will be added to the relevant shipping rates and the costs of the cash-on-delivery payment method, if applicable. In any case, these rates will be communicated to the customer before finalizing the purchase.

The purchase receipt corresponding to the purchase order will be sent to the email address provided by the customer when completing the order form.

The customer must pay the corresponding amount for their order by credit or debit card, or cash on delivery.

Security

Babunkers uses the highest security measures commercially available in the industry. Furthermore, the payment process operates on a secure server using the SSL (Secure Socket Layer) protocol. The secure server establishes a connection so that the information is transmitted encrypted using 128-bit algorithms, ensuring that it is only intelligible to the client's computer and the Website's computer. Thus, using the SSL protocol guarantees:

  • That the client is communicating its data to the Babunkers server center and not to any other server trying to impersonate it.
  • Data is transmitted encrypted between the client and the Babunkers server center, preventing it from being read or manipulated by third parties.

Babunkers also states that it does not have access to confidential data related to the payment method used, and therefore does not store it. Only 'La Caixa' has access to this data for the purpose of managing payments and collections, and it is inaccessible to other third parties.

Order formalization

Once the order has been placed, the CU has been accepted, and the purchase process has been confirmed, Babunkers will always send the customer an email confirming the details of the purchase.

Order cancellation

Babunkers will accept order cancellations when requested before they have left our warehouses. To cancel, go to My Orders, enter your username and password, and cancel the order. Cancellations requested via email will not be accepted.

Once the order has been assigned or shipped, cancellations will not be accepted for operational reasons. If you still wish to cancel the order once it has been assigned or left our warehouse, you must return it by following the steps in the returns section.

Deadlines, place of delivery and loss

Product delivery

Babunkers is committed to delivering the product in perfect condition to the address indicated on the order form. In order to optimize delivery, we ask that customers provide an address where the order can be delivered during normal business hours.

Babunkers will not be liable for delivery errors when the delivery address entered by the customer on the order form is incorrect or has been omitted.

Babunkers informs the customer that a single order may be divided into several deliveries.

Intellectual and industrial property

Babunkers holds all rights to the content, design, and source code of this website, including, but not limited to, the photographs, images, text, logos, designs, trademarks, trade names, and data included on the website.

Customers and users are advised that such rights are protected by current Spanish and international legislation regarding intellectual and industrial property.

Likewise, and without prejudice to the foregoing, the content of this website is also considered a computer program, and therefore, all current Spanish and European Community regulations on the matter also apply to it.

Any reproduction of this website, in whole or in part, or of any of its contents, is expressly prohibited, even through a hyperlink, without the express written permission of Babunkers.

  2. Failures or incidents that may occur in communications, deletion, or incomplete transmissions, so there is no guarantee that the website services will be constantly operational.
  3. For errors or damages caused to the website due to inefficient and bad-faith use of the service by the customer.
  4. Due to inoperability or problems with the email address provided by the customer for sending the order confirmation.
  5. In any case, Babunkers is committed to resolving any problems that may arise and offering all necessary support to the customer to reach a quick and satisfactory resolution to the incident.
  6. Likewise, Babunkers has the right to conduct promotional campaigns for defined periods of time to encourage new customer registration. Babunkers reserves the right to modify the conditions of the promotions, extend them with due notice, or exclude any participant from the promotion if it detects any anomaly, abuse, or unethical behavior in their participation.
